Allen v. Lake City Community College Foundation, Inc.

Kristen Van der Linde, and Matthew Havice, won a Motion for Summary Judgment in Columbia County, Florida on behalf of Lake City Community College Foundation, Inc. The case involved Plaintiff Christopher Allen, who suffered injuries resulting from the loss of control over his vehicle and striking another car when he came upon a slippery, mud-covered road. Apparently, the road conditions were due to a mud bogging event held on February 13 and 14, 2004. The plaintiff alleged that LCCCF was negligent because it knew or should have known of the dangerous condition, failed to take reasonable steps to prevent or avoid its creation, and owed a duty to the public who could potentially be exposed to the dangerous condition on the road. However, LCCCF did not participate in the event that caused the mud to collect on the road, nor did it prepare the racing surface, control or determine who could participate in the event, or have any part in deciding what spectators or participants entered the event. Accordingly, the judge granted Matthew Havice’s Motion for Summary Judgment.
